What can be done by a person if his property is acquired by someone illegally?
The problem of illegal possession is quite rampant these days. Even with the proper title deeds, a person can face the issue of illegal possession.
Some legal recourses which the person can adopt include-
- A person who is disposed of his property can get possession by title under the Section 5 of the Specific Relief Act.
- He can get valid possession under Section 6 of the Specific Relief Act by proving that he had previous rightful possession and he was dispossessed wrongfully.
- A criminal complaint can also be initiated under section 145 of Crpc. All the important documents are required to be presented while filing the complaint.
- A complaint for trespass under the IPC and wrongful dispossession can also be filed.
- A written complaint can be addressed to the Superintendent of Police of the area where property is situated and if he fails then a private complaint can be filed in the court.
