A life interest is the transfer of the property which lasts only during the lifetime of the owner. The person in whose name the life interest is created is known as the life tenant. A life tenant holds property as a trustee during his lifetime. He acts as a fiduciary to the property. The property is not transferred absolutely to the tenant and hence he cannot deal with it as if he owns it. Life tenancy can also be created for an unborn child or a minor. In some cases, the widow might be entitled to a life interest while her children get the ownership of the property.

What is a partition?
Partition means to divide the property into different shares and dividing it amongst the rightful share-holders.
A property can be partitioned in three ways-

- Partition deed – in this case a deed is prepared by the family members with mutual consent. The deed must be executed on a stamp paper and must be registered with a Sub-registrar’s office.
- Family settlement– in this the family divides the property amongst themselves in a peaceful manner through negotiations and deliberations. This prevents future litigation. The settlement does not require registration but it is like an agreement and must be signed by all family members.
- Instituting a suit- when all the family members are not on the same page on partitioning of the property, one or more co-owners can institute a suit in the court which has the required jurisdiction.
