How long does it take to obtain a mutual consent divorce?
The mutual consent divorce takes a reasonable time ranging from 6months to about 2 years. The court decides this time on the basis of the facts, circumstances and complexities involved in each case. The Supreme Court, in a recent case, has also ruled that the waiting period of 6 months can also be waived off, if the parties are able to prove that there are no chances left to reconciliate the marriage. What is Alimony and how is it calculated?
The term maintenance and alimony are interchangeably used. Maintenance is an amount paid by the dependent spouse to the other spouse during or after the divorce proceedings. The amount is generally provided if a spouse is unable to maintain himself which in most of the cases is the wife. But in some exceptional cases, the court has also asked the wife to maintain her husband.
There are two types of maintenance/alimony-
It refers to the maintenance amount paid by one spouse to the dependent party during the pendency of the litigation. This amount has to be paid from the date of initiation of the suit till the passing of the final judgment.
After passing the final decree of divorce, the court might direct the husband/ wife to make a lump-sum payment or periodic payments to the dependent spouse. Usually, the spouse is directed to make periodic payments (weekly, monthly or yearly). Only in rare cases like mutual consent divorce, the spouse is asked to make a lump sum payment.
The court has not laid down a proper mathematical formula to calculate the amount of maintenance to be paid to the dependant spouse. It can be provided as a periodical payment or as a one-time lump sum amount. In case of periodical payment (monthly) of alimony, the Supreme Court has benchmarked not more than 25% of the husband’s net salary as the alimony amount. No such amount has been decided for a one-time payment, but usually it ranges from 1/3rd to 1/5th of the net worth of the husband. The court after evaluating all the facts and circumstances, including standard of living of both the spouses, decides the alimony amount.
